Backyard Music Co. Host & Venue Terms and Conditions
By setting up an event with Backyard Music Co., you agree to the following terms and conditions. Please read these terms carefully before proceeding.

1. Event Commitment
Non-Cancellation Policy:
Once tickets are sold for your event, you are committed to hosting the event. Cancellations are not permitted unless in the case of an emergency, which must be communicated to Backyard Music Co. immediately.
Refunds for cancellations are only issued in extreme circumstances, such as natural disasters, government-mandated restrictions, or serious safety concerns, at the discretion of Backyard Music Co.
Emergency Cancellation:
In the rare event that a cancellation is necessary due to an emergency, Backyard Music Co. will work with the host or venue to reschedule the event. If rescheduling is not possible, guests will be offered a full refund for their ticket purchase.

2. Ticket Revenue and Venue Proceeds
Backyard Music Co. will retain 100% of all ticket proceeds for both backyard and venue-based events.
For venue-based events, the venue will retain 100% of any proceeds from food, beverage, and alcohol sales.
Backyard Music Co. will handle all ticket sales and processing through its platform, while the venue will manage food and beverage operations during the event.

3. Health and Safety
The host or venue is responsible for ensuring that the event is conducted in a safe manner that prioritizes the health and well-being of all guests, artists, and staff.
Host/Venue Responsibilities for Health and Safety:
• Provide a safe and accessible environment for all attendees.
• Ensure emergency protocols are in place, including the location of first-aid kits, fire exits, and emergency contacts.
• Comply with all local health regulations, including any requirements for public health measures (e.g., sanitation stations, masks, etc.).
• Monitor guest behavior to ensure that no activities pose a risk to the safety of others.
COVID-19 and Public Health Requirements:
The host or venue agrees to comply with any public health guidelines in place at the time of the event. In the event of government-mandated restrictions, Backyard Music Co. will work with the host or venue to reschedule the event or issue refunds to guests if the event cannot proceed.

4. Artist Arrangements
Artist Lineup Flexibility:
Due to the nature of live music events, artist arrangements may be subject to change, even at the last minute. Backyard Music Co. reserves the right to substitute or modify the artist lineup as necessary without prior notice.
Tier Adjustments:
The host or venue acknowledges that the artist lineup is contingent upon ticket sales reaching specific goals. If these goals are not met, Backyard Music Co. reserves the right to adjust the event tier and corresponding artist lineup or cancel the event. The host and guests will be notified of any changes.

5. Alcohol Policy
If the host or venue chooses to serve alcohol, they must hold the appropriate liquor license for their jurisdiction.
Backyard Music Co. will not be held responsible for any incidents, damages, or legal consequences that arise from the illegal serving of alcohol or from guests’ behavior related to alcohol consumption.
For BYOB (Bring Your Own Beverage) events, it is the responsibility of the host or venue to clearly communicate alcohol policies to guests in advance.

6. Non-Compete and Artist Exclusivity Clause
The host or venue agrees that they will not directly contact or book any artist who performs at their Backyard Music Co. event for any future events without going through Backyard Music Co.
This clause applies for a period of 24 months after the event date.
If the host or venue breaches this agreement, Backyard Music Co. reserves the right to pursue legal action to recover damages.

7. Noise and Permits
The host or venue is responsible for ensuring that the event complies with local noise bylaws and regulations. If a permit is required to host a live music event, it is the host or venue’s responsibility to obtain it in advance. Backyard Music Co. will not be held liable for any fines, penalties, or event interruptions due to non-compliance.

8. Event Safety and Security
The host or venue is responsible for ensuring that the event environment is safe for all attendees. This includes providing appropriate lighting, seating, and accessibility as needed.
If necessary, the host or venue should consider hiring security personnel to assist with guest management and maintain order. Backyard Music Co. will not be held liable for injuries, accidents, or incidents that occur due to unsafe conditions or lack of security.

9. Photography and Privacy
By attending a Backyard Music Co. event, guests agree that photos and videos taken during the event may be used by Backyard Music Co. for promotional purposes.
If a guest does not wish to be photographed, they should notify the host or Backyard Music Co. representative at the event. Backyard Music Co. respects guest privacy and will not share personal information with third parties without consent.

10. Force Majeure
Backyard Music Co. will not be held liable for any delays, interruptions, or cancellations caused by circumstances beyond its control, including but not limited to natural disasters, extreme weather, government restrictions, public health emergencies, or acts of God.
In such cases, Backyard Music Co. will work with the host or venue to reschedule. If rescheduling is not possible, a full refund will be issued to ticket holders.

11. Payment and Fees
Backyard Music Co. will retain 100% of ticket proceeds for both backyard and venue-based events.
The venue will retain 100% of any proceeds from food, beverage, and alcohol sales.
Backyard Music Co. will process all ticket sales and provide ticketing support through its platform.

12. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Ontario, Canada. Any disputes arising from or related to these terms will be subject to the exclusive jurisdiction of the courts in Ontario, Canada.
By agreeing to these Terms and Conditions, the host or venue acknowledges their responsibilities and obligations as part of the Backyard Music Co. community and commits to upholding the standards and practices that ensure the success and enjoyment of every event.
